Pre-order Terms & Conditions

The following conditions regulate the pre-sale of products featured on this website by our company:

Website: www.wallacehume.comCustomer: a natural person who is of legal age and who is not acting within the context of practicing a profession or conducting a business, with whom Wallace Hume V.O.F. concludes an Agreement.
Pre-order: an agreement between Wallace Hume V.O.F. and the customer made for the delivery of one or more products, which Wallace Hume V.O.F. accepted as such.  The customer understands that the ordered products will be delivered after the pre-order campaign is ended on 15 August 2017.
Product: a Wallace Hume V.O.F. product that Wallace Hume V.O.F. offers on the website for sale.

Pre-order

Wallace Hume is accepting pre-orders for Wallace Hume Watches and Wallace Hume Straps (a ”Product”) from 5 June 2017 until 15 August 2017 (“the Pre-order Campaign”). Pre-ordering a product means that you will pay for your product at the time that you make the pre-order, but that the product(s) will be delivered at a later date (estimated to be August 2017). By pre-ordering a product(s) you represent and warrant that you have read these Terms and that you accept that Wallace Hume takes the payment for your pre-order when you make the order rather than at delivery of your pre-ordered product(s).

Liability

Wallace Hume has until 15 August 2017 time to clarify the provision and, after clarity fully respect the delivery. However, they can not be held liable for any delay in delivery.

Shipping

The estimated date for start of shipment of the pre-ordered product(s) is August 2017. This date represents Wallace Hume’s best estimate at the time of writing but it is preliminary and subject to change.

Delivery

The delivery of the products purchased during the pre-order action will take place in an appropriate, protective packaging and gift box. If Wallace Hume can not realize the target on or before the ending of our pre-order period of 15 August 2017 we can not guarantee delivery, the purchasing party shall be notified and they will be entitled to a refund of the amount paid to them. In the period between the time of the pre-order and delivery, the purchaser shall be regularly kept informed of the progress of the production. If a product is unexpectedly delivered in a defective condition, the purchaser must notify Wallace Hume as soon as possible (within 48 hours) via our contact page. Wallace Hume will ensure the return costs and proper handling.

Warranty policy

Should you regret your pre-order and wish for a full refund, you may do so if the product has not been shipped by 15 September 2017, up until receipt of the pre-ordered product(s). Please contact the Customer Care team via contact page

Cancellation of pre-orders

Wallace Hume reserves the right to refuse an order for any reason. Wallace Hume also reserves the right to cancel any pre-order, which we have already accepted. Should an accepted order be canceled, Wallace Hume will refund any payments for such order. However, Wallace Hume will not be liable for any other damage or costs. An accepted order may be canceled and refunded under (including but not limited to) the following circumstances. a. the Product becomes unavailable; b. your billing information is not correct or not verifiable; c. our security systems flag your pre-order as an unusual order or an order susceptible to fraud; d. your payment is not received within 12 calendar days after we have accepted your pre-order; e. there was any error in the price quoted for your order; f. we are or were unable deliver to the address you provided.

Limitation of liability

In no event shall Wallace Hume be liable for any incidental, indirect, special, exemplary, or consequential damages arising from or relating to these terms of purchase or the use of or inability to use or deliver any product, even if Wallace Hume knew or should have known of the possibility of such damages. Wallace Hume’s aggregate cumulative liability arising from or relating to these terms and conditions and the use of, or inability to use, or deliver, any product, whether in contract or tort or otherwise, shall in no event exceed the price paid by the customer for such product.

Warranty

Wallace Hume makes no warranties, express or implied, about the shipment date of the product(s).

Force majeure

Neither party shall be liable, for damages nor any other consequences, if the party’s obligations according to these Terms and Conditions, other than the obligation to pay money, are inhibited or delayed by circumstances that the party cannot reasonably control or foresee, including but not limited to, any conflict in the workforce; natural phenomena such as lightning, earthquakes, floods etc.; fire; war; decisions and decrees made by governments or authorities; accidents; strikes or shortages of transportation facilities, fuel, energy, labor or materials; or similar circumstances.

Entire Agreement

This agreement, together with the herein referenced documents, constitute the entire agreement with regards to the subject matter between you and Wallace Hume. It supersedes and merges any prior proposals, understandings, and communication. Any modifications to these Terms and Conditions must be made in writing.

Contracting company

This agreement is entered into between you and Wallace Hume (Wallace Hume V.O.F.) Wallace Hume reserves the right to fulfill our obligations according to this agreement through any subsidiary, parent or otherwise affiliated company, without notice to you.
